Zoning Minutes, 25 January 2007

On-going Development Projects

4444 Montrose (Contact East):  Townhouse development.  Developer is planning to put a sales trailer on the site in the next month or two.  They are dealing with some past environmental issue costs with the seller (underground storage tanks).  They hope to break ground in the late spring.  A resident commented that he felt the traffic study was inadequate due to only being conducted on one day; he expressed concerns regarding traffic flow, particularly on garbage pickup day.

4657 Wilson:  A Mayfair resident reported recent survey marks on the sidewalk in front of the property which are consistent with the developer’s initial proposal to build 3 homes with front-loading garages facing Kilpatrick.  The community objected to this plan due to the front-loading garages and additional curb cuts.  The most recent proposal the Committee received from this developer was to add a single family home on the property facing Wilson, which would require a zoning change from R3 to R3.5 in order to build a two-story house on the east portion of the property.  The general membership voted no to the zoning change at the November 16th meeting.  The committee feels that with the efforts to downzone the community to R2 a zoning change to R3.5 would not be in the best interest of the community. 

4426-4432 Kilbourn: This is the property that was recently purchased by Blue Sky Development with plans and permits for 4 single family houses with front-loading garages. The developer has agreed to work with the community and recently presented sketches for 4 single family houses with 2 shared driveways to rear garages, which were approved by the general membership. No new information regarding this project was available.  It was recommended to complete the petition process for downzoning for this block as quickly as possible.

4616 Kilbourn:   The single frame house on this property has been torn down.  Foundations have been poured and construction is under way for 2 new homes with front garages.

4623-29 Kenton: This property was for sale with one house and one vacant lot. The Ziggy Realty for sale signs were recently removed. The committee will try to find out if the property is off the market.

4452-4456 Wilson:  Homeowner plans to tear down this single home on a 50 foot lot and replace with 2 homes.  Permits are not yet issued.

4400 Kenton:  A house with a large lot is FSBO.

4300 Montrose:  Property for sale next to Buddhist temple.  A recommendation was made to initiate work on a statement outlining desired characteristics for additional development on Montrose to use as a template for discussion for developers.  Tom Nelson to initiate a draft for discussion at future meetings.  OIP expressed interested in working on this jointly with us.

Down-Zoning Project

The following blocks have completed petitions and balloting is under way or complete:
4300-4400 Leland
4400-4600 Kostner
4400 to 4424 Wilson (north side)
4600 Kenneth (east side)
4600 Kilbourn
4500 Knox (East side)

Ordinances to downzone these blocks to RS-2 have been already introduced or will be introduced at the February 7 City Council Meeting.

Further information needs to be obtained on the inclusion of St. Edward’s church and school properties in the downzoning on Kostner.

Other Blocks with petitions in progress include:

4600 Kenton
4400-4500 Kilbourn
4500 Kenneth

Suggestions were received to speak with Alderman Levar regarding downzoning by precinct or a larger area due to the time and labor intensity of the current process.  It was noted that the petition and balloting process is not a legal requirement, and that the Alderman could request the ordinance in bulk.  The general downzoning to RS-2 would provide immediate protection from further development while it would still be possible to “spot upzone” for specific projects which the community supports.  Other comments that there should remain a voice for the individual community members to vote.
